The partner dashboard credits a cashback site with most of last month’s demat account openings, and finance wants to release the payout. Before it does, compliance asks what the site told its readers about returns. IT asks a different question: why was the tracking script reading phone numbers off the sign-up form? Neither question is about the commission rate. Both decide whether a fintech referral programme survives its first audit, and both trace back to how the affiliate tracking software was set up.

The short answer: Affiliate tracking software for a fintech referral programme has to credit partners for approved customers, fire only after consent, keep applicant data out of partner and analytics views, and record who each partner is and what they published. The 18-item checklist below catches the gaps that vendor demos skip. The growth or alliances lead runs it, and compliance, IT security and finance each sign the rows they own before anyone signs the contract.

What should affiliate tracking software do for a fintech, and who owns the decision?

Affiliate tracking software records which partner sent a customer, what that customer did and what the partner is owed. For a bank, NBFC, AMC, insurer or fintech, it also has to prove the programme stayed inside the rules, because regulators treat a paid partner’s words and data handling as the brand’s own problem.

A handful of terms come up in every vendor call. An affiliate is a publisher paid per result through a tracked link or code, such as a personal finance blog or a cashback app. A referral partner introduces customers under a contract: an accountant, a payroll platform, an existing customer. In lending, a DSA (direct selling agent) sources borrowers for a bank or NBFC, and a lending service provider (LSP) does similar work digitally on the lender’s behalf. CPA (cost per acquisition) is the payout per completed action, and most of this checklist turns on which action you choose to pay for.

Vendor comparison pages rank tools on link builders, dashboards and payout automation. Those matter. A regulated brand, though, fails audits on four other things: what counts as a conversion, what data the tool touches, who the partner is and what the partner said.

Give the checklist one owner, the growth or alliances lead who will run the programme, and split sign-off by row. Compliance signs the partner eligibility and disclosure rows. IT security or your data protection officer signs consent, data and retention. Finance signs payout and clawback. Engineering confirms the postback from your core system. A row with no named signatory is not done. For the wider stack, our marketing analytics and martech work covers how the tracker connects to your CRM and consent tools.

Who can a bank, AMC, insurer or lender pay for a referral?

The software can only enforce rules you have written down, so settle partner eligibility before you compare features. The answer differs by product, and the tool has to store the proof for each partner. This is general guidance, not legal advice; your compliance team decides.

  • Securities and mutual funds. SEBI’s rules, notified in August 2024 and explained in its October 2024 circular on association, bar regulated entities and their agents from any direct or indirect association with a person who gives securities advice without registration or claims returns without permission. In our reading, a paid affiliate link is an association, so a finance creator who posts stock tips is out however good the traffic looks. A mutual fund distributor must quote a valid AMFI registration number (ARN) to receive commission.
  • Lending. RBI’s digital lending rules, issued in May 2025, keep the lender fully responsible for the acts and omissions of its lending service provider. The lender must publish its LSPs and their apps on its website. A comparison site paid per approved loan may be doing LSP work, so ask compliance before you pay it like a blog.
  • Insurance. Indian insurance law limits commission or rewards for soliciting insurance to insurance agents and registered insurance intermediaries. An unregistered affiliate cannot simply be paid per policy. IRDAI’s 2024 policyholder-protection regulations also require the insurer’s written approval before a distribution channel issues an advertisement.
  • Disclosure. ASCI’s influencer guidelines list “Affiliate” among acceptable disclosure labels and expect the label upfront, not hidden in a bio or at the end of a post. For partners abroad, the US Federal Trade Commission says advertisers need reasonable programmes to train and monitor network members, and that the company is responsible for what others do on its behalf.

Each rule becomes a field in the tool: registration number, expiry, products the partner may promote and the date disclosure was last checked. If the tool cannot hold them, keep a partner register keyed to the tracked partner ID.

The affiliate tracking software checklist: 18 items to check before you sign

Score each row yes or no. A yes needs the evidence in the fourth column, not a vendor’s assurance. Run the checks in a sandbox during the trial with a test applicant your team creates.

Rows 6 to 10 and row 12 are gate rows: consent, data and partner eligibility, the areas an auditor tests first.

What we’ve learned across 320+ projects: the row teams tick without keeping evidence is partner monitoring. Everyone agrees partners use approved creatives, yet when compliance asks what a cashback site said about the product in a given month, nobody has a dated capture of the page. Book a monthly capture of every active partner page and file it against the partner record. It is dull work, and it answers the audit question in minutes.

What will compliance and IT ask before they approve a tracking tool?

Expect five questions from compliance and IT. Answer them in writing before the first review meeting.

  1. What is tracked before consent, and what only after? Write it as a table, like the one below, and attach the network log from a declined-consent test.
  2. Where could personal data leak? List every place a phone, email or PAN could appear: scripts reading form fields, URL parameters, sub-IDs, postbacks, partner exports.
  3. How long is each kind of data kept, and who deletes it? Give the setting in the tool and the clause in the contract.
  4. Where is the data hosted, and under what agreement? Attach the vendor’s hosting statement and the data processing agreement.
  5. Who at the partner sees what? Attach a screenshot of the partner view.

Here is the consent decision we would put to a reviewer for a lending or investing journey. Applicant data stays inside your own systems.

Data pointBefore consentAfter consentWhere it may live
Partner ID carried in the linkKept in your own first-party session onlyPassed to the trackerYour server and the tracker
Tracker click ID and cookieNot setSet, with the window your contract statesTracker
Applicant name, phone, email, PANNever sentNever sentYour core system only
Application status by internal IDNot sentSent by server postbackYour server and the tracker
KYC documents and credit dataNever sentNever sentYour core system only
Payout amount per conversionNot applicableCalculated in the trackerTracker and finance system

The postback carries an internal reference and a status, nothing more. Your system can match the reference to a customer in a dispute; the tracker and the partner hold no one’s identity. That one choice clears rows 7 and 8.

India’s Digital Personal Data Protection Act, 2023 asks for consent that is free, specific, informed, unconditional and unambiguous, given by a clear affirmative action, and withdrawable as easily as it was given. Data must be erased once the purpose is served or consent is withdrawn, unless another law requires it to be kept, and you stay responsible for your processors. The DPDP Rules were notified on 14 November 2025 with an eighteen-month phased compliance period. For digital lending, RBI’s rules add need-based collection with the borrower’s prior, explicit consent and an audit trail, only basic minimal data held by an LSP, and storage on servers in India. This is general guidance, not legal advice.

If Google’s tags run beside the tracker, pick a consent mode setting on purpose. In the basic setting, tags do not load until the visitor interacts with the banner and nothing reaches Google if they decline. In the advanced setting, tags load straight away and, if the visitor declines, send cookieless pings that Google uses for modelling. Basic is easier to explain to a reviewer. Record which you chose and who approved it.

On retention, a standard Google Analytics 4 property keeps user-level and event-level data for two or fourteen months. Set the tracker to cover your payout and dispute window plus your records policy, and no longer.

How do you score the checklist, and when should you stop?

Count the no answers, but count gate rows first. A single no in rows 6 to 10 or row 12 means stop and fix before launch, whatever the rest of the sheet says. Among the other twelve rows, three or more no answers also means stop and fix. One or two means you may launch, provided each has a named owner and a fix date.

Launch rule: gate rows with a no = 0, and other rows with a no ≤ 2, each with an owner and a date.

Take a hypothetical NBFC choosing affiliate tracking software for a personal loan referral programme. Vendor A has the best dashboard and scores 15 yes and 3 no: retention fixed at the vendor default (row 9), no clawback (row 3) and no monitoring captures (row 15). Vendor B looks plainer and scores 14 yes and 4 no, none in gate rows.

Vendor A fails a gate row and Vendor B has four ordinary gaps, so both stop. The difference shows in the fixes. Vendor A’s retention gap was a contract clause, which left two ordinary gaps and a pass. Vendor B’s gaps needed product work. The type of gap decided it, not the score.

Re-score after every fix and keep each dated sheet. They answer the auditor’s question about why you chose the tool.

A referral payout you cannot trace to an eligible partner and an approved page is a compliance cost, however cheap the customer looked.

How do you adapt the checklist for lenders, AMCs, insurers and Gulf markets?

Keep the 18 rows and add the few your product or market needs. Yamm Labs works from Gurugram and supports Gulf programmes remotely, so local counsel should sign the Gulf rows.

  • Lenders and NBFCs. Pay at disbursement, not approval. Add a row confirming the partner’s page names the lender. RBI’s Key Facts Statement rules require the lender to give the borrower a statement with the annual percentage rate before the loan contract is executed, so keep partner copy off rate promises.
  • AMCs, brokers and investment apps. Add the ARN check for distributors and a SEBI association check for every creator partner, covering their whole channel and not only the post you paid for. Partner creatives for mutual funds carry SEBI’s standard warning, which video and audio ads must show and voice clearly.
  • Insurers. Route partners through a registered intermediary where the law requires it, and add a row for the insurer’s written approval of each partner advertisement. Set clawback to the free-look period.
  • B2B fintech. When you sell to banks, partners are consultants and system integrators. The conversion is a signed contract, the window runs for months and the partner record needs a deal registration step.
  • UAE. The federal personal data protection law and the separate DIFC Data Protection Law set their own consent rules, so confirm which applies to your entity and where the vendor hosts. Pinsent Masons reported in June 2025 that the Securities and Commodities Authority, since renamed the Capital Market Authority, introduced a licensing regime for people who publish financial content, so add a licence field for UAE creator partners.
  • Saudi Arabia. SAMA’s advertising rules set a minimum list of disclosures, including the institution’s name and logo, fees and commissions with VAT, and the APR, and partner creatives must carry them. Creators who earn from social media advertising need a permit under the Mawthooq licensing rules of the General Commission for Audiovisual Media, as Arab News reported.

What should you do with a failed item?

Treat a failed item as a task with an owner and a date, then decide whether it is a setting, a contract term, a workaround or a reason to walk away.

  1. Classify it as a gate row or an ordinary row. Gate rows block launch; ordinary rows get a fix date.
  2. Ask the vendor in writing whether it is a setting, a roadmap item or a no, and ask for a date.
  3. Look for a workaround you control. Route postbacks through your own server and strip personal fields before they leave. Keep monitoring captures outside the tool if it has no archive.
  4. Put the fix into the contract (retention, deletion on request, hosting, audit log access, exit terms), then re-run the row in the sandbox.
  5. If a gate row cannot be fixed by a setting, a clause or a workaround, drop the vendor.

Once tracking passes, the next question is whether partners bring customers you would not have won anyway. That is a measurement problem, not a tracking one, and our guide to marketing measurement for financial brands covers holdout tests and how to report incrementality to a CFO.

What should you tell your compliance team?

Send a short note before the first review, so the reviewer starts from your evidence:

“We plan to run a referral programme on the attached tracking tool. Partners are paid only for approved customers, and only partners whose registration is recorded in the tool can receive payouts. Tracking starts after consent; applicant personal data never leaves our core system, and partners see counts and status only. The checklist, scoring sheet and evidence folder are attached, with the gate rows marked.” This is general guidance, not legal advice; your compliance team decides.

People also ask

What is the difference between affiliate tracking software and a referral programme tool?

Affiliate tracking software is built for publishers paid per result through tracked links, with attribution rules, fraud controls and partner payouts. Referral tools usually serve customers inviting friends, with simpler rewards. A fintech running both needs one partner register holding registration, consent state and clawback.

Can a fintech pay finfluencers through affiliate links in India?

It depends on the product and the creator. SEBI bars regulated entities and their agents from associating with people who give securities advice without registration or make return claims without permission, and insurance commission is limited to licensed agents and registered intermediaries. Check each creator’s registration and whole channel before issuing a link, and ask your compliance team.

Should affiliate commissions be paid on sign-ups or on approved customers?

Pay on the stage that makes you money and that a partner cannot fake: an approved account, a disbursed loan or a first premium. Paying on sign-ups attracts applicants who fail KYC or the credit check. Add a clawback for reversals.

Does affiliate tracking need cookie consent in India?

India’s Digital Personal Data Protection Act asks for consent that is free, specific, informed and unambiguous before personal data is processed for a purpose such as tracking. The safer design sets tracker cookies only after consent and keeps applicant identity out of the tracker. Your data protection officer should confirm how this applies to your journeys; this is general guidance, not legal advice.
